Terms of Service

1. Acceptance of Terms

By creating a Sycado account, accessing the platform, or using any Service provided by Sycado (a product of Polsia, Inc.), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are using Sycado on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. In that case, "you" refers to that entity.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sycado is an AI-powered marketing automation platform that provides:

• AI marketing agents (20+ specialized agents) for content creation, campaign management, and distribution
• Multi-channel content distribution across social media, email, advertising networks, and directories
• Competitor analysis, SEO tools, keyword research, and audience intelligence
• Integration with third-party advertising platforms (Google Ads, Meta, LinkedIn, etc.)
• Analytics, reporting, and campaign performance tracking
• White-label and agency management capabilities (Agency/Enterprise plans)

The Service is provided on a subscription basis. Features vary by subscription tier. We reserve the right to modify, add, or remove features at any time with reasonable notice.

3. Account Registration

To use Sycado, you must create an account with a valid email address. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials confidential and secure
• Notify us immediately at security@sycado.com if you suspect unauthorized access
• Accept responsibility for all activity under your account

You must be at least 16 years old to create an account. One person or entity may not maintain more than one free account.

We reserve the right to refuse service, terminate accounts, or cancel subscriptions at our sole discretion if these Terms are violated.

4. Subscriptions & Billing

Plans

Sycado offers subscription plans billed monthly or annually:

• Spark Plan — $47/month (or $38/month billed annually)
• Pro Plan — $97/month (or $78/month billed annually)
• Agency Plan — $297/month (or $238/month billed annually)
• Enterprise Plan — $997/month (or $797/month billed annually)

Current pricing is available at sycado.polsia.app/pricing. We reserve the right to change prices with 30 days' advance notice.

Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually).
• Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on each renewal date.
• Prices are in USD. You are responsible for any applicable taxes, currency conversion fees, or bank charges.
• Subscription renews automatically until cancelled.

Upgrades & Downgrades

You may upgrade or downgrade your plan at any time from your billing settings. Upgrades take effect immediately (prorated). Downgrades take effect at the next billing cycle.

Failed Payments

If a payment fails, we'll retry up to three times over 7 days. Continued failure may result in service suspension. You'll receive email notifications. Update your payment method in billing settings to restore access.

5. Cancellation & Refund Policy

Cancellation

You may cancel your subscription at any time through your account settings or by emailing hello@sycado.com. Cancellation stops future renewals. Your access continues until the end of your current paid period.

Refunds

We offer the following refund policy:

• 7-day money-back guarantee: If you are unsatisfied with Sycado within 7 days of your first payment (new customers only), contact us for a full refund. No questions asked.
• Renewals: We do not offer refunds on subscription renewals. Cancel before your renewal date to avoid the next charge.
• Annual plans: If you cancel an annual plan within 30 days of initial purchase (and have not used the service extensively), we may offer a prorated refund at our discretion.
• Exceptions: In cases of service outage exceeding 24 hours or billing errors, we will provide prorated credits or refunds as appropriate.

To request a refund, email billing@sycado.com with your account email and reason.

6. Acceptable Use

You agree to use Sycado only for lawful purposes and in accordance with these Terms. You must not:

Prohibited Content

• Generate or distribute illegal content, including content that infringes intellectual property rights, defames others, or violates privacy rights
• Create spam, unsolicited bulk email, or deceptive marketing materials
• Generate content that is hateful, discriminatory, violent, or harassing
• Create fake reviews, testimonials, or misleading endorsements
• Generate content that impersonates individuals, brands, or organizations without authorization

Prohibited Actions

• Attempt to reverse-engineer, scrape, or extract the platform's proprietary AI models, prompts, or infrastructure
• Use the platform to compete directly with Sycado (i.e., build a competing AI marketing platform using our infrastructure)
• Resell or sublicense access to the Service without written permission (except as allowed under Agency plan terms)
• Circumvent platform usage limits, rate limits, or access controls
• Use automated scripts or bots to access the platform outside of our official API
• Introduce malware, viruses, or harmful code
• Use the platform in any way that violates applicable laws or regulations, including CAN-SPAM, GDPR, CCPA, FTC guidelines, or platform-specific terms of service (Google, Meta, etc.)

Marketing Compliance

You are solely responsible for ensuring that all marketing content generated through Sycado complies with applicable advertising laws, platform-specific policies (Google, Meta, LinkedIn, TikTok, etc.), and industry regulations. Sycado provides tools — you are the advertiser of record.

We reserve the right to suspend or terminate accounts that violate these acceptable use standards, without refund.

7. AI-Generated Content

AI Outputs Are Not Guaranteed

Sycado uses AI to generate marketing content, strategies, and campaigns. AI-generated outputs may contain errors, inaccuracies, outdated information, or content that requires review before publication. You are responsible for reviewing and approving all AI-generated content before use.

Ownership of Outputs

Subject to these Terms, AI-generated content created through your use of Sycado is owned by you. We do not claim copyright or ownership over your outputs. You are responsible for ensuring your outputs do not infringe third-party intellectual property rights.

No Legal or Professional Advice

AI-generated content on Sycado does not constitute legal, financial, medical, or professional advice. Any contract templates, compliance guidance, or professional content generated by AI should be reviewed by qualified professionals before use.

Model Behavior

AI models may occasionally produce outputs that are unexpected, off-topic, or inconsistent. We continuously improve our prompts and safeguards, but cannot guarantee any specific output. If an AI agent behaves unexpectedly, report it via our support system.

8. Intellectual Property

Sycado's IP

The Sycado platform, brand, interface, proprietary technology, AI agents, prompts, and underlying infrastructure are owned by Polsia, Inc. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on Sycado's proprietary elements.

Your Content

You retain ownership of all content you submit to Sycado — brand guidelines, campaign briefs, uploaded assets, and AI-generated outputs. By using the Service, you grant Sycado a limited license to process, store, and use your content solely to provide the Service to you.

Feedback

If you submit feedback, suggestions, or ideas about Sycado, you grant us a perpetual, royalty-free, worldwide license to use that feedback to improve the platform. We won't identify you as the source without your permission.

9. Third-Party Integrations

Sycado integrates with third-party platforms (Google Ads, Meta, LinkedIn, TikTok, Twitter/X, and others). These integrations are subject to the respective platform's own Terms of Service and policies. We are not responsible for:

• Changes to third-party platform policies that affect your campaigns or integrations
• Account suspensions or restrictions imposed by third-party platforms
• Accuracy of data returned from third-party APIs
• Downtime or disruptions in third-party services

By connecting third-party accounts, you authorize Sycado to access and use those accounts on your behalf as directed by you. Disconnect integrations at any time from your account settings.

10. Privacy

Your use of Sycado is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

11. Disclaimer of Warranties

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure at all times
• AI-generated content will be accurate, complete, or suitable for your specific use case
• Marketing campaigns run through Sycado will achieve any specific results, revenue, or return on investment
• Integrations with third-party platforms will function without interruption

Marketing results depend on many factors beyond our control (market conditions, competition, audience, budget, etc.). We make no guarantees of specific outcomes.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

• Sycado's total liability to you for any claims arising from these Terms or the Service will not exceed the greater of: (a) the amount you paid Sycado in the 3 months preceding the claim, or (b) $100 USD.
• We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or reputational damage — even if advised of the possibility of such damages.
• We are not liable for marketing campaign performance, ad spend results, or outcomes from AI-generated content.
• We are not liable for actions taken by third-party platforms (account bans, policy violations, ad disapprovals).

Some jurisdictions do not allow limitations on implied warranties or exclusion of incidental damages, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sycado, Polsia, Inc., and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your violation of any third-party rights (intellectual property, privacy, etc.)
• Content you submit to or generate through the platform
• Your marketing campaigns or advertising activities
• Your violation of applicable laws or regulations

14. Termination

By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion at hello@sycado.com. Your access continues until end of the paid period.

By Sycado

We may suspend or terminate your account immediately (without refund) if:

• You violate these Terms, particularly Acceptable Use provisions
• We receive credible reports of illegal activity associated with your account
• Your continued use poses a risk to our platform, other users, or third parties
• We are required to do so by law

We'll make reasonable efforts to notify you before termination unless prohibited by law or immediate action is required to prevent harm.

Effect of Termination

Upon termination: your right to use the Service ends immediately; your data will be retained per our Privacy Policy and then deleted; provisions that by nature should survive (IP ownership, indemnification, limitation of liability, dispute resolution) continue to apply.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution

Before filing any formal claim, you agree to contact us at hello@sycado.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

Any disputes arising from these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in English on a remote basis.

Class action waiver: All claims must be brought in an individual capacity. You waive the right to bring or participate in any class action, collective action, or representative proceeding against Sycado.

Exceptions

Either party may seek injunctive or other equitable relief in court to prevent irreparable harm or protect intellectual property rights, without waiving the right to arbitration for other claims.

16. Changes to Terms

We may update these Terms periodically. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Email registered users at least 14 days before changes take effect
• Display an in-app notification for significant changes

Continued use of the Service after the effective date of changes constitutes acceptance of the new Terms. If you disagree with the updated Terms, cancel your subscription before the effective date and stop using the Service.
